1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of picdefense.io, app.picdefense.io, and all related services (collectively, the “Service”) operated by Reliable Channel LLC dba PicDefense (“we,” “us,” or “PicDefense”).
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before they take effect.
2. The Service
PicDefense is an image compliance platform. We provide tools to:
- Crawl and inventory images across your websites.
- Analyze images for copyright risk using forensic engines (reverse image search, visual matching, AI-based scoring).
- Store proof of licensing, receipts, and compliance documentation in a secure vault.
- Monitor your sites on an ongoing basis and alert you to compliance changes.
- Generate exportable evidence reports (Defense Kits) for use by you or your legal counsel.
The Service provides forensic data and risk intelligence. It does not provide legal advice, legal representation, or guaranteed legal outcomes. See Section 7 for the full disclaimer.
3. Your Account
You must provide accurate information when creating an account. You are responsible for maintaining the security of your credentials and for all activity under your account.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By creating an account, you represent that you meet this requirement.
Notify us immediately at [email protected] if you suspect unauthorized access to your account.
4. Payment and Refunds
Subscriptions
Paid plans are billed on a recurring basis (monthly or annually as selected). You are charged at the start of each billing period. All fees are in US dollars unless otherwise stated.
Credits (One-Time Scans)
You may purchase PicDefense credits for one-time image analysis (1 credit = 1 image analyzed). Due to the computational costs of image analysis, processing, and report generation, credits used on completed scans are non-refundable. Unused credits may be refunded within 30 days of purchase upon request.
Refund Policy
Because each scan consumes real processing resources (crawling, image analysis, AI scoring, report generation), we cannot refund completed analysis work. This applies to subscription scans and credit-based scans alike.
We will issue refunds for: technical errors on our part (failed report delivery, incorrect billing), and unused credit balances requested within 30 days of purchase. Contact [email protected] within 7 days of a billing issue.
Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No prorated refunds are issued for the remaining time in a billing cycle. Your data remains accessible until the end of the paid period.
5. Acceptable Use
You agree not to:
- Use the Service to scan websites you do not own or have authorization to scan.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Abuse the Service to overload our infrastructure or interfere with other users.
- Use the Service for any unlawful purpose or to transmit harmful or fraudulent content.
- Resell, sublicense, or redistribute access to the Service without a written agency agreement.
- Misrepresent PicDefense reports as legal opinions or official legal documents.
We reserve the right to suspend or terminate accounts that violate these rules.
6. Intellectual Property and User Content
Our Intellectual Property
The Service, including its software, design, branding, and documentation, is owned by Reliable Channel LLC and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.
Your Content
You retain ownership of all content you upload to the Service, including licenses, receipts, and compliance documents stored in your Proof Vault. We do not claim ownership of your content.
You grant us a limited license to host, process, and display your content solely to operate the Service for you. This license terminates when you delete your content or account (subject to the data retention terms in our Privacy Policy).
Generated Reports
Scan reports, risk scores, and Defense Kits generated by the Service are produced for your use. You may share them with your legal counsel, team members, or other parties as you see fit. You may not represent them as independent legal opinions.
7. Not Legal Advice
PicDefense is a technology platform, not a law firm. Nothing in the Service constitutes legal advice.
Risk scores, source intelligence, forensic match data, and Defense Kit reports are provided for informational and operational purposes only. They are designed to help you organize evidence and understand your compliance posture — not to replace professional legal counsel.
- Using the Service does not create an attorney-client relationship.
- We do not guarantee the outcome of any legal dispute, demand letter negotiation, or settlement.
- If you are facing significant financial liability or an active lawsuit, consult a qualified intellectual property attorney.
PicDefense provides the organized evidence. Your legal counsel provides the strategy.
8. Limitation of Liability
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Reliable Channel LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Reliable Channel LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service — even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim arising from or related to these Terms or the Service is limited to the amount you paid to PicDefense in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages. In those jurisdictions, the limitations above apply only to the extent permitted by law.
No Indemnification by PicDefense. PicDefense has no obligation to indemnify, defend, or hold harmless Customer against any third-party claim, including without limitation claims of copyright or other intellectual property infringement relating to images analyzed, identified, scored, or reported on by the Service. Risk scores and scan results are probabilistic assessments, not determinations of copyright status or licensing validity.
9. Indemnification by You
You agree to indemnify, defend, and hold harmless Reliable Channel LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party right, including any intellectual property right, or (d) any content you upload to or process through the Service.
10. Termination
You may close your account at any time through your account settings or by contacting [email protected].
We may suspend or terminate your access if you violate these Terms, engage in prohibited activity, or if required by law. We will make reasonable efforts to notify you before termination except where prohibited by law or where immediate action is needed to protect the Service.
Upon termination, your right to use the Service ceases immediately. Data deletion follows the retention schedule in our Privacy Policy. Sections 7 (Not Legal Advice), 8 (Limitation of Liability), 9 (Indemnification by You), and 11 (Governing Law) survive termination.
11. General
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Texas.
Severability
If any provision of these Terms is found unenforceable, that provision is modified to the minimum extent necessary and the remaining provisions continue in full force.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Reliable Channel LLC regarding the Service.
